Introduction
These general terms and conditions of sale govern all contracts concluded from the Internet site accessible at the URL address https://www.stragier.com.
They are concluded between Association Stragier, Le Weya, 1 – 1457 Nil Saint Vincent, registered in the Companies Register under number BE0693.381.734, and the private or professional Client.
IMPORTANT
Any order placed on the https://www.stragier.com website implies unreserved acceptance by the customer of these general terms and conditions of sale (GTCS).
Stragier may unilaterally modify these GTC, so it is necessary that they be reread by the buyer at each visit and/or before placing any order on the site. These modifications are enforceable from the moment they are put online and cannot be applied to contracts concluded previously. The general terms and conditions of sale applicable to the purchaser are those in force on the date of the order. Each purchase on the site is governed by the general terms and conditions applicable on the date of the order. The purchaser is deemed to have read these General Terms and Conditions of Sale and to accept them automatically and without reservation by confirming the order on the site. We consider that by validating your order, you accept our General Terms and Conditions of Sale unreservedly after reading them. By accessing the Site, you undertake to comply with the General Terms and Conditions and the Conditions of Use contained therein.
Definitions
“Terms and Conditions ” means: the general terms and conditions of sale set out below, governing the rights and obligations arising from the sale and purchase of products via the www.stragier.com website.
“Stragier” or “Stragier Association” means the drafter of these Conditions in its capacity as seller.
“Order” means: the firm intention of the Buyer to enter into a commercial transaction in accordance with these Conditions.
“Goods” means: all tangible items which may be the subject of a contract of sale between the Buyer and the Seller.
“Contrat” means: the commercial relationship established following acceptance by the seller, Stragier, of the order placed by the buyer in accordance with these general terms and conditions.
“Delivery” means: the operation by which the goods are effectively made available to the purchaser by Stragier or on behalf of Stragier.
“Terms of use” means: the procedure/methods applicable to any order placed on the site.
Orders
The customer can place an order on the http://www.stragier.com website.
The sale is deemed concluded upon receipt of payment for the order placed on the website. By placing an order online, the client explicitly states that he/she wishes to enter into a sales contract with ‘Stragier’ and agrees to these general terms and conditions. The client is informed of the confirmation of this order by e-mail, hereinafter referred to as confirmation e-mail, which summarises the terms of the order. ‘Stragier’ reserves the right to refuse orders for geographical reasons or to set special conditions specific to the contract. If an order is not accepted by ‘Stragier’ or if ‘Stragier’ wishes to set special conditions specific to the contract, ‘Stragier’ shall notify the purchaser thereof within 7 days of receipt of the order.
The information provided by the client at the time the order is taken is binding on the client: in the event of an error in the recipient’s contact information, the seller may not be held liable for the impossibility of delivering the product.
All promotions issued by ‘Stragier’ are not binded to us and may be unilaterally revoked. A promotion has a specific period of validity, mentioned on the website.
Promotional offers and prices are valid only as long as they are visible on the site and within the limits of available stocks.
Product details
All products are described as precisely as possible.
The information relating to the essential characteristics of the products is made available online, in particular by means of technical descriptions and photographs illustrating the products.
‘Stragier cannot be held responsible for any difference in colour or material/structure/texture between the photos on the website and the goods delivered.
Stragier’ uses a system of samples so that the client can examine the goods before purchase. These samples can be ordered via the http://www.stragier.com website.
In the event of an additional order for identical goods, ‘Stragier’ cannot guarantee that the material has the same bath number. Similarly, differences in baths and structures between the model delivered and the sample or between separate deliveries are unavoidable and cannot in any way engage the responsibility of ‘Stragier’, in accordance with commercial practice in the sector.
Availability
In the event that one of the products ordered is not available, the customer will be contacted by e-mail within 7 days from the date of the order.
‘Stragier cannot be held responsible for the temporary or definitive unavailability of a product, and no compensation may therefore be claimed.
Price
The prices of the goods mentioned on the website at the time of ordering will be those applicable to the sale. All orders placed on the http://www.stragier.com website are payable when the order is placed.
Prices are expressed in euros and include VAT.
Delivery costs are indicated to the customer and are invoiced at the end of the order in addition to the price of the goods ordered.

Please note: cheques and bank transfers are not accepted.
We accept payment by Visa and MasterCard. If you choose to pay with a credit card, the money is immediately withdrawn from your card upon confirmation of payment.
‘Stragier’ remains the legal owner of the goods until full payment of the sums owed by the purchaser within the specified period.
Delivery
Delivery costs are indicated to the User and are invoiced at the end of the order in addition to the price of the goods ordered. Delivery costs are calculated according to the weight of the goods selected. Once the order has been validated by ‘Stragier’, these costs are fixed and are no longer subject to change. The order will be delivered to the address indicated when the order was placed.
Delivery charges will be invoiced to the buyer for each new order placed on the site.
In addition, for deliveries outside Belgium, the customer undertakes to pay all taxes due on the import of products, customs duties, value added tax and any other tax due under the laws of the country in which the order is received. ‘Stragier’ declines all legal liability in the event of non-payment of taxes by the customer.
‘Stragier’ cannot be held responsible for delays, which cannot give rise to damages, deductions or interest.
In the event of non-receipt of a parcel within the indicated deadlines for a reason not attributable to ‘Stragier’, an investigation will be carried out.
These steps may take up to 28 days for the carrier.
During this period, the transaction will be suspended and no refund or return will be possible.
Goods conformity
The client must check the conformity of the goods and indicate any anomaly concerning the product (missing product or damaged package, defective product, etc.) within a period of 2 months.
The client must send any reservations regarding the lack of conformity of existing products by email to ‘Stragier’, at the address info@stragier.com with the following information:
- Order number
- Name and address
- reference of the item(s) to be returned
- reason for the return for non-conformity
A claim on a product which, after its reception, would have been cut, sewn, modified or transformed cannot be taken into account.
In the event of non-conformity or damage during transport, Stragier will apply the provisions laid down for this purpose by the Civil Code.
Cancellation option
The customer has the right to notify the seller, in writing or on a durable medium, that he/she withdraws from the purchase without penalty and without giving any reason, within 14 days from the day following the delivery of the product.
Once the customer has informed Stragier of their wish to withdraw, they have 14 calendar days to return one or all of the items. The only costs charged to the customer as a result of exercising his/her right of withdrawal are the direct costs of returning the goods.

The sums paid by the customer shall be reimbursed within 14 days following the withdrawal or the recovery of the goods by Stragier. The customer may not exercise the right of withdrawal for contracts for the supply of goods cut to size, according to the consumer’s specifications or clearly personalised.
Stragier uses a sample system to allow the client to examine the goods prior to purchase.
For items or packaging that are incomplete, damaged, soiled or modified by third parties and/or the purchaser exceeding the handling required for the item to function properly, the purchaser may be claimed compensation for the damage caused.

Warranty
Our products come with a 2-year legal warranty.
Samples
Samples can be ordered for a defined selection of fabrics. Shipping and sampling costs will always be charged to the customer and will be indicated at the time the sample order is confirmed. As a reminder, differences in baths and structures between separate deliveries are unavoidable and cannot in any way engage the responsibility of ‘Stragier’, in accordance with commercial practice in the sector.
Gift certificates
- Gift certificates are not refundable or exchangeable for cash.
- Gift certificates can only be used on our website and at the Stragier shop in Nil-Saint-Vincent.
- Gift certificates are not reloadable.
Protection of personal information
As the information you provide is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts, its absence will result in the cancellation of your order. By registering on the site, the customer undertakes to provide true and sincere information about him or herself. The communication of false information is contrary to these general terms and conditions as well as to the conditions of use appearing on the site. ‘Stragier’ is authorised to collect, process and use information concerning clients. This data is processed electronically. The customer has a permanent right of access and rectification of all data concerning him/her, in accordance with European texts and national laws in force (article 34 of the law of 6 January 1978 on the protection of privacy). The user may at any time make a request to ‘Stragier’ in order to find out what information it has about him/her. He may at any time and upon request modify this data. ‘Stragier’ is the sole holder of the information concerning the user and undertakes not to disclose it to third parties without the user’s consent. Promotional emails offering new products, clearance offers, exclusivities and bargains may be sent. You can ask not to receive any more emails by clicking on the unsubscribe link.
Intellectual property rights
The entire content of the www.stragier.com site (illustrations, texts, wording, trademarks, images, photos, videos, etc.) is the property of ‘Stragier’. Any partial or total reproduction, modification or use of these texts, images, photos or any other content of the site for any reason and on any medium whatsoever, without the express prior written consent of ‘Stragier’ is strictly prohibited. Any improper use of these contents constitutes an offence of counterfeiting, severely punished by the Intellectual Property Code.
Disputes and liability
‘Stragier’ cannot be held responsible for the consequences resulting from the misuse by the buyer of the goods sold on the site. ‘Stragier’ shall not be held liable for the non-execution of the contract entered into, on the one hand in the event of force majeure, as defined by the courts, and on the other hand in the event of the client’s fault or the unforeseeable and insurmountable act of a third party to the contract. We remind you that it is prudent to back up the data contained in the products purchased. Any dispute relating to the application and performance of these General Terms and Conditions of Sale may only be brought before the courts of Nivelles.
Acceptance of our general terms and conditions of sale
After selecting the products, to access the ‘order’ section, the customer must declare, by ticking the icon provided for this purpose, that they have read and accept the G.S.C. In the event of any contradiction between these G.S.C. and any other document issued by the site (prospectus, catalogue, sales proposals, etc.), these conditions shall prevail.
